By using any of our Services (even just browsing one of our websites or accessing our platforms), you agree to the following Terms and Conditions. If you do not agree with these Terms, you may not use our Services.
These Terms of Service, Conditions of Use, Refund Policy, and Privacy Policy (collectively, the “Terms and Conditions”) are entered into by and between you and American Dream Trading, LLC, a Virginia limited liability company taxed as an S Corporation (“American Dream Trading,” “ADT,” “we,” “us,” or “our”), and govern your access to and use of www.americandreamtrading.com and all related content, platforms, communities, applications, materials, and services (collectively, the “Site”). The Site includes, without limitation:
“Securities” as used herein shall include but not be limited to money, securities, commodities, futures, cryptocurrency, and other investments of every kind and nature, and all contracts and options relating thereto, whether for present or future delivery.
In consideration of your access to and use of the Site, we require every member and customer (each, a “Customer,” “Member,” or “you”) to act with integrity, abide by our rules, and comply with these Terms and Conditions.
By clicking “I Agree,” creating an account, making a purchase, joining our Discord server, accessing our Whop storefront, or otherwise using or accessing the Site, you acknowledge that you have received, read, and understood these Terms and Conditions. Clicking “I Agree” or using our Services is the legal equivalent of manually signing these Terms and Conditions, and you will be legally bound hereby.
Section I
A. By clicking “I Agree” and/or using or accessing the Site, you agree that: (a) you have received, read, and understood these Terms and Conditions, and that these Terms and Conditions create a valid and binding agreement enforceable against you in accordance with the terms hereof; (b) you agree to be bound by these Terms and Conditions, and any additional terms, conditions, rules, regulations, or policies of American Dream Trading, as each may be amended or supplemented from time to time in our sole discretion; and (c) your use of the Site shall comply with all applicable federal, state, and local laws, rules, or regulations, and you are solely responsible for your compliance with any such applicable laws. If you do not agree with any portion of these Terms and Conditions, you are prohibited from using or accessing the Site.
B. By using or accessing the Site, you represent and warrant that you: (a) are eighteen (18) years of age or older; (b) are not currently restricted from using the Site or otherwise prohibited from having an account with us; (c) are not a competitor of American Dream Trading or using the Site for any competitive purpose; (d) have full power and authority to enter into and perform these Terms and Conditions; (e) will not violate any rights of American Dream Trading, including intellectual property rights; and (f) agree to provide, operate, and maintain, at your sole risk, cost, and expense, all equipment, software, and internet access necessary to use the Site.
C. Without limiting the generality of the foregoing, you acknowledge and agree as follows:
D. All content, materials, and services related to the Site shall be solely used for your own personal use in connection with your trading education and activities, and for no other use.
E. Violating any of the aforementioned will result in immediate removal from American Dream Trading and forfeits your right to request a refund.
Section II
A. By becoming a Customer of American Dream Trading and using the Site, American Dream Trading hereby grants to you a limited, revocable, non-exclusive, non-transferable license to use the Site and its content, materials, and services, solely for your personal use and for the purposes set forth on the Site, subject to these Terms and Conditions. Such limited revocable license is freely revocable and terminable by American Dream Trading at any time, without cause and in its sole discretion. This limited revocable license shall automatically be revoked and terminated upon any violation of these Terms and Conditions. Upon revocation or termination, you shall destroy any materials (electronic or otherwise) related to the Site that remain in your possession or control.
B. American Dream Trading reserves all rights not expressly granted in these Terms and Conditions, including title, ownership, intellectual property rights, and all other rights in and to the Site, our products and services, and all related content, materials, and derivative works thereof. You acknowledge that the Site and all related materials are owned by American Dream Trading and protected by copyright, trademark, and other intellectual property laws.
C. You grant American Dream Trading an exclusive, irrevocable, worldwide, perpetual, unlimited, freely assignable and sublicenseable, fully paid-up and royalty-free right to use, copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, analyze, and commercialize any information, content, ideas, concepts, techniques, data, or suggestions submitted to the Site, including but not limited to content posted in our Discord server, Whop community, or any other platform operated by American Dream Trading.
Section III
A. American Dream Trading may host in-person and virtual events from time to time. These events may be recorded and photographed for marketing and/or the production of educational content. By attending American Dream Trading events (whether in-person or virtual), you agree to allow American Dream Trading to utilize audio, video, and photographs in which you may appear for any lawful business purpose.
Section IV
A. American Dream Trading reserves the right to investigate violations of these Terms and Conditions or any applicable law, and to pursue any remedy available. You acknowledge that American Dream Trading may notify, involve, and cooperate with law enforcement authorities in investigating and prosecuting users who violate these Terms and Conditions.
B. American Dream Trading has no obligation to screen or monitor users or content but reserves the right to do so at any time in its sole discretion. American Dream Trading may remove any content and terminate the subscription, membership, or account of any user that violates these Terms and Conditions or posts content that American Dream Trading finds objectionable.
C. American Dream Trading may, in its sole discretion, cancel, suspend, or terminate your account if you breach these Terms and Conditions. American Dream Trading may refuse to permit any person to access or use the Site for any reason at any time.
Section V
A. Through the Site and our Whop storefront, American Dream Trading offers both individual products for sale and subscription-based or membership-based periodic services. For individual products, a valid payment method will be required and the amount will be charged concurrently with the completion of the purchase. When you purchase an individual product, you will receive a streaming or digital version; no physical copies will be shipped.
B. When purchasing subscription or membership services, a valid payment method will be required for billing purposes. You hereby consent to the storage of such payment information by American Dream Trading or its third-party payment processors (including but not limited to Whop, Stripe, and any successor platforms).
C. Upon signing up for a subscription or membership, the fees associated with the first period will be charged immediately. Your subscription or membership will automatically renew at the end of each period, and the applicable fees will be charged to your payment method. If your payment method fails, American Dream Trading may immediately terminate your account or service. It is solely your responsibility to ensure valid payment information remains on file.
D. All payments made to American Dream Trading are non-refundable. American Dream Trading does not offer, and is not required to provide, any refunds or credits for any reason, including dissatisfaction or failure to cancel prior to automatic renewal. There is no circumstance in which you will be entitled to a refund. Notwithstanding the foregoing, nothing in this section limits any rights you may have under applicable state or federal consumer protection laws that cannot be waived by contract.
E. All fees are exclusive of any taxes, levies, or duties imposed by any taxing authority, and you are responsible for the payment of all such taxes arising from your purchases.
Section VI
A. American Dream Trading reserves the right to modify the Site, including the content, materials, services, and fees associated with the Site, at any time and without notice. American Dream Trading reserves the right to modify or discontinue, temporarily or permanently, the Site or any part thereof without notice. New features shall be subject to these Terms and Conditions and may result in price increases. American Dream Trading shall not be liable for any modification, price change, suspension, or discontinuance of the Site.
B. American Dream Trading may communicate with you through email, mobile number, telephone, or delivery services about your account or services. You acknowledge that American Dream Trading shall have no liability arising from your failure to maintain accurate contact information.
Section VII
A. Your account or service may be cancelled at any time; provided that no refunds will be issued for the remaining portion of any prepaid period.
B. You are solely responsible for properly cancelling your account. Cancellation may be completed by: (i) using the cancellation functionality on the applicable platform (including Whop or the Site’s Member Dashboard); or (ii) requesting cancellation in writing by email to support@americandreamtrading.com. Email cancellation requests require confirmation of receipt from American Dream Trading. Cancellation requests by telephone or other means will not be accepted.
C. Cancellation will result in the deactivation and deletion of your account, denial of access to the Site, and forfeiture of all content and information within your account. No data can be recovered once cancelled. American Dream Trading may retain data in backup or archival copies.
Section VIII
A. American Dream Trading utilizes artificial intelligence (“AI”) tools and automated systems in various aspects of its business operations, including but not limited to content creation, social media management, market research, image generation, and educational material development.
B. Content published by American Dream Trading on the Site, social media platforms, Discord, Whop, or any other medium may be generated, drafted, edited, or assisted by AI tools. Such content is reviewed for accuracy and compliance but may contain errors, inaccuracies, or outdated information.
C. AI-generated content does not constitute investment advice, financial advice, legal advice, tax advice, or any personalized recommendation. All AI-generated content is provided for informational and educational purposes only, consistent with the disclaimers set forth in Section X of these Terms and Conditions.
D. Market data, statistics, stock prices, or other financial information referenced in AI-generated content may not be current, accurate, or complete. You should independently verify all such information before making any investment decision.
E. American Dream Trading makes no representation or warranty regarding the accuracy, completeness, reliability, or suitability of any AI-generated content. Your reliance on AI-generated content is solely at your own risk.
Section IX
A. The Site is provided on an “as is” and “as available” basis, with no warranties whatsoever.
B. American Dream Trading disclaims to the fullest extent permitted by law all express, implied, and statutory warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. American Dream Trading does not warrant that: (i) the Site will meet your specific requirements; (ii) the Site will be uninterrupted, timely, secure, or error-free; (iii) any results obtained from your use of the Site will be valid, accurate, or reliable; (iv) the quality of any products, services, or information obtained through the Site will meet your expectations; or (v) any errors in the Site will be corrected.
C. American Dream Trading disclaims any warranties for any information, content, or advice obtained through the Site, and disclaims any warranties for services or goods received through or advertised on the Site.
D. Your use of the Site is solely at your own discretion and risk, and you will be solely responsible for any liability, damages, or expenses that result from your use of the Site.

Section XI
A. Whether or not advised of the possibility of such damages, American Dream Trading and its directors, officers, members, employees, agents, and affiliates shall not be liable to you for: (a) any consequential, incidental, punitive, exemplary, special, or indirect damages of any kind, including lost profits, revenues, and business; or (b) any damages in excess of three times the most recent monthly fee paid by you, or $250, whichever is greater.
B. This limitation of liability shall apply regardless of whether the limited remedies provided herein fail of their essential purpose, and shall not apply to any damage intentionally caused by American Dream Trading in violation of these Terms and Conditions or applicable law, or as otherwise mandated by applicable law that cannot be disclaimed.
Section XII
A. You shall indemnify and hold harmless American Dream Trading and its officers, directors, members, employees, agents, and affiliates from any and all claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising from: (i) your breach of these Terms and Conditions; (ii) your use of the Site or any products or services of American Dream Trading; (iii) your trading activities or investment decisions; or (iv) your use of, access to, or activity on the Site.

This section constitutes our Privacy Policy and describes how we collect, use, disclose, and protect your personal information in compliance with the Virginia Consumer Data Protection Act (VCDPA), and other applicable federal and state privacy laws.

We use your information to: provide and improve our services; process transactions and send related communications; communicate with you about your account, products, and services; analyze usage patterns to improve the Site; deliver targeted content and marketing; comply with legal obligations; prevent fraud and enforce our Terms and Conditions; and operate our AI-powered business tools and automation systems.
D. Tracking Technologies and Advertising Pixels
We may use tracking pixels, cookies, and similar technologies from third-party advertising platforms including but not limited to: X (Twitter) Pixel, Meta (Facebook/Instagram) Pixel, Google Analytics, and other advertising and analytics platforms. These technologies help us measure the effectiveness of our marketing, understand user behavior, and deliver relevant content. You may opt out of targeted advertising through your browser settings or the opt-out mechanisms provided by the applicable advertising platforms.
E. How We Share Your Information
We may share your personal information with: third-party service providers who assist in operating our business (payment processors, analytics providers, email services); advertising platforms for remarketing purposes; law enforcement or regulatory bodies when required by law; and professional advisors such as attorneys and accountants. We do not sell your personal information to third parties.
F. Your Rights Under the Virginia Consumer Data Protection Act (VCDPA)
If you are a Virginia resident, you have the following rights regarding your personal data:

G. Data Retention
We retain your personal information for as long as your account is active or as needed to provide you services. We may retain certain information after account cancellation for backup, archival, legal compliance, or legitimate business purposes.
H. Data Security
We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
I. Children’s Privacy
The Site is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete such information promptly.
J. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Site with a revised effective date.
Section XIV
A. American Dream Trading reserves the right to revise these Terms and Conditions at any time. Material changes will be communicated through the Site or by email. By continuing to use the Site after changes are posted, you agree to be bound by the then-current version of these Terms and Conditions.
Section XV
A. Informal Resolution. Before filing any formal proceeding, you agree to first attempt to resolve any dispute with American Dream Trading informally by contacting us at support@americandreamtrading.com. We will attempt to resolve the dispute within thirty (30) days of receiving your notice.
B. Binding Arbitration. If a dispute cannot be resolved informally, you agree that any controversy or claim arising out of or related to these Terms and Conditions or the provision of services by American Dream Trading shall be resolved by individual (not class-wide nor collective) binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The arbitration shall take place in the Commonwealth of Virginia, unless the parties mutually agree to a different location or to virtual proceedings. The arbitrator’s decision shall be final and binding, and judgment upon the award may be entered in any court having jurisdiction.
C. Costs and Fees. Each party shall bear its own costs and attorneys’ fees in connection with the arbitration, except as otherwise required by the AAA Consumer Arbitration Rules or applicable law.
D. Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against American Dream Trading. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute shall be resolved in court.
E. Exceptions. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
Section XVI
A. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. To the extent that any claim is not subject to arbitration under Section XV, such claim shall be exclusively resolved by a state or federal court located in the Commonwealth of Virginia. You agree to submit to the personal jurisdiction of such courts.
B. The Site is solely directed to and intended for individuals residing in the United States. Those who access the Site from other locations do so at their own risk and are responsible for compliance with all applicable laws.
Section XVII
A. If any provision of these Terms and Conditions is found to be illegal, void, or unenforceable, the unenforceable provision will be modified to render it enforceable to the maximum extent possible. If modification is not possible, it shall be severed, and the remaining provisions shall remain in full force and effect.
Section XVIII
A. These Terms and Conditions constitute the entire agreement between you and American Dream Trading regarding the Site and supersede all prior agreements and understandings, whether written or oral. The provisions of these Terms and Conditions shall survive any termination thereof indefinitely.

A. Our failure to act with respect to a breach of these Terms and Conditions does not waive our right to act with respect to that breach or subsequent breaches.
